Terms of Service

1. Acceptance of Terms

By accessing or using the FloodMaps website and its related services (the "Service"), provided by Afterblast LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Afterblast LLC provides automated property flood risk reports and related data through the FloodMaps platform. The Service synthesizes publicly available data and historical records to generate informational reports. Afterblast LLC is a private entity and is completely independent. We are not affiliated with, endorsed by, sponsored by, or connected to the Federal Emergency Management Agency (FEMA), the National Oceanic and Atmospheric Administration (NOAA), or any local, state, or federal government agency.

3. Extremely Important Disclaimers & Assumption of Risk

You acknowledge and agree that the data provided by Afterblast LLC is strictly for informational and educational purposes only.

  • Not Official Data: Our reports are NOT a substitute for an official Elevation Certificate, a professional land survey, or an official FEMA Standard Flood Hazard Determination Form.
  • No Guarantee of Accuracy: While we strive for accuracy, flood risk is inherently unpredictable. The Service relies on historical data, third-party feeds, and automated analysis, which may contain errors, omissions, or outdated information.
  • Not for Official Decision Making: You agree NOT to use the Service's data as the sole or primary basis for real estate purchases, mortgage approvals, property insurance underwriting, or life-safety decisions during severe weather events.
  • Assumption of Risk: You assume all risk associated with the use of the reports generated by Afterblast LLC. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of the Service.

4. Payments, Subscriptions, and Refunds

Report Purchases:

Payments for Premium Report packages are processed immediately. Because the digital report is delivered instantly upon purchase, all sales are final and non-refundable.

Subscriptions:

We may offer recurring subscription plans. By enrolling in a subscription, you authorize us (via our third-party payment processor) to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings; however, no prorated refunds will be issued for the remainder of the billing cycle.

Payment Processing:

All payments are handled by a secure third-party processor. Afterblast LLC does not store your credit card information on its servers.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AFTERBLAST LLC, ITS FOUNDERS, MEMBERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, PROPERTY DAMAGE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

Under no circumstances will Afterblast LLC be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or your account. In no event shall our total liability to you for all claims arising out of or relating to the use of the Service exceed the amount you paid to Afterblast LLC in the past twelve (12) months.

6. Intellectual Property

The Service and its original content (excluding user-provided data), features, and functionality are owned by Afterblast LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. When you purchase a report, you are granted a limited, non-exclusive, non-transferable license to view and use that specific report for your personal or internal business purposes.

7. Acceptable Use & Prohibited Conduct

You agree not to engage in any of the following prohibited activities in connection with your use of the Service:

  • Automated Access: Using bots, crawlers, scrapers, or any automated means to access, collect, extract, or index data from the Service, including but not limited to flood risk reports, map data, property analysis, or any other content.
  • Data Harvesting & Resale: Systematically downloading, storing, redistributing, sublicensing, or reselling any data, reports, or analysis obtained from the Service, whether individually or in aggregate, without the prior written consent of Afterblast LLC.
  • AI & Machine Learning Training: Using data obtained from the Service to train, fine-tune, or otherwise develop any artificial intelligence model, machine learning system, or competing product or service.
  • Abuse of Unlimited Packages: Unlimited Report packages are intended for reasonable individual or small-team use. Afterblast LLC reserves the right to monitor usage and, at its sole discretion, throttle, suspend, or terminate access for any account exhibiting usage patterns reasonably deemed excessive, abusive, or inconsistent with normal use—including, without limitation, bulk automated generation, systematic data extraction, or usage suggesting redistribution or commercial resale.
  • Circumvention: Attempting to bypass, disable, or otherwise circumvent any security, access control, rate-limiting, or usage-monitoring feature of the Service.

Violation of these terms may result in immediate account suspension or termination without refund, and Afterblast LLC reserves the right to pursue any legal remedies available.

8. SMS Terms

FloodMaps may offer SMS-based features, including property summary responses, account-related communications, and service notifications. By providing your mobile number or initiating a text conversation with FloodMaps, you agree to receive transactional text messages related to your use of the Service. Message frequency may vary, and message and data rates may apply based on your mobile carrier plan.

Your mobile information will not be sold or shared with third parties for promotional or marketing purposes. We may use trusted service providers to deliver requested text messages and support the Service, subject to our Privacy Policy.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Harris County, Texas, to resolve any legal matter arising from these Terms.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
